The agreement between you and Nustream Digital Ltd for using the Recall app — including your subscription and your End User Licence Agreement (EULA).
Last updated [effective date]·Recall iOS app
Draft — needs legal review
This is a complete draft Terms of Use / EULA written from how Recall actually works, and it includes the clauses Apple requires when an app ships its own EULA. Have a UK-qualified solicitor review it before publishing — especially the liability, consumer-rights and subscription sections. Every highlighted item is a blank only you can fill.
01About these terms
These Terms of Use ("Terms") are a legal agreement between you and Nustream Digital Ltd, a company registered in England and Wales (company number 16079701, registered office First Floor, Swan Buildings, 20 Swan Street, Manchester M4 5JW) ("Recall", "we", "us"). They govern your use of the Recall application and related services.
By downloading, installing or using Recall, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Recall.
02Who can use Recall
You must be at least 18 years old to use Recall. By using the app you confirm that you are 18 or over and that you are able to enter into a binding contract.
03Your licence to use Recall
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use Recall on any Apple-branded device that you own or control, as permitted by the App Store Usage Rules in Apple's Media Services Terms and Conditions. This licence is for your own personal, non-commercial use.
You may not copy, modify, reverse-engineer, decompile, redistribute, sell, rent or sub-licence the app, except to the extent the law expressly permits.
04Your account
You need an account to use Recall. You are responsible for the security of your account and the device it runs on, and for activity that takes place under your account. Tell us promptly at support@recall-app.ai if you believe your account has been compromised.
05Subscriptions, trial & billing
Recall is offered as an auto-renewing subscription. A subscription is required to use the app's features.
Free trial
New users may be offered a free 14-day trial. If you do not cancel at least 24 hours before the trial ends, the trial automatically converts to a paid subscription and your Apple ID is charged for the tier you selected. Any unused portion of a free trial is forfeited when you buy a subscription.
Tiers, price & renewal
Recall is offered in several subscription tiers — currently Lite, Pro and Max — each available on a monthly or annual basis. The price of each tier is shown in the app and on the App Store before you purchase, and varies by country and region. Payment is charged to your Apple ID at confirmation of purchase.
The subscription renews automatically at the same tier and price for a further period of the same length, unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
Managing & cancelling
You can manage or cancel your subscription, and turn off auto-renew, in your Apple ID account settings (Settings → your name → Subscriptions) at any time. Cancelling stops the next renewal; it does not retroactively refund the current period.
Refunds & price changes
Purchases are processed by Apple, and refunds are handled by Apple in line with Apple's policies and your statutory rights. If we change the subscription price, we will give you notice and the change will not take effect until your next renewal; if you do not accept it, you can cancel.
06Acceptable use
When using Recall you agree not to:
use the app for any unlawful purpose, or to save, store or process content that is illegal;
save content that infringes someone else's intellectual property or privacy, where you have no right to do so;
upload material that is malicious, or attempt to disrupt, overload, probe or reverse-engineer the service;
use the app to harass, abuse or harm others, or to generate content that sexualises or endangers children;
attempt to circumvent usage limits, security measures or the subscription requirement;
use automated means to access the service except as we expressly permit.
We may suspend or terminate access that breaches these rules.
07Your content
The content you save into Recall — your library — remains yours. We do not claim ownership of it.
To operate the service, you grant us a limited, worldwide, royalty-free licence to host, store, copy, process, transmit and display your content solely to provide and improve Recall for you — including sending it to the service providers described in our Privacy Policy and sub-processors page for AI processing and content extraction. This licence ends when you delete the content or your account, except for copies retained briefly in backups or as the law requires.
You are responsible for the content you save and confirm you have the right to save it. We do not routinely monitor saved content, but we may remove content or suspend accounts where we reasonably believe these Terms or the law have been broken.
08AI features & their limits
Recall uses artificial intelligence to summarise, tag and classify what you save, and to power search, the Ask tab and Chat with Bookmark. AI output can be inaccurate, incomplete or out of date. It is provided to help you, not as professional advice, and you should not rely on it for legal, medical, financial or other important decisions without checking the original source. You are responsible for how you use AI-generated output.
09Our intellectual property
Recall, including the app, its design, the "Recall" name and logo, and all related software and content (other than your content), is owned by Nustream Digital Ltd and protected by intellectual property laws. Nothing in these Terms transfers any of those rights to you.
10Third-party services
Recall relies on third-party services to function, and lets you save content from third-party platforms. We are not responsible for third-party content, websites or services, and your use of them may be subject to their own terms. You agree to comply with any applicable third-party terms when you use Recall.
11Support & maintenance
Nustream Digital Ltd — not Apple — is solely responsible for providing any maintenance and support for Recall. If you need help, contact us at support@recall-app.ai or visit our Help page. Apple has no obligation to provide any maintenance or support for the app.
12Disclaimer of warranties
To the fullest extent permitted by law, and subject to your statutory rights in section 14, Recall is provided "as is" and "as available". We do not warrant that the app will be uninterrupted, error-free, or that AI output will be accurate. Nustream Digital Ltd — not Apple — is solely responsible for any warranties, whether express or implied by law, to the extent they cannot be disclaimed.
13Limitation of liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under the law of England and Wales.
Subject to that, and to your consumer rights in section 14, we are not liable for loss or damage that is not reasonably foreseeable, for loss of data arising from your own failure to keep backups or copies, or for business losses. Our total liability to you for any claim connected with the app will not exceed the amount you paid us for the subscription in the 12 months before the claim arose.
14Your consumer rights
If you are a consumer, you have legal rights under the Consumer Rights Act 2015 and other UK consumer protection law — including that digital content must be of satisfactory quality, fit for purpose and as described. Nothing in these Terms affects those statutory rights, and where any term conflicts with them, your statutory rights prevail. For advice about your rights, contact the Citizens Advice consumer service.
15Termination
You can stop using Recall and delete your account at any time — see our account deletion page. We may suspend or end your access if you materially breach these Terms, if required by law, or if we discontinue the service. If we discontinue the service, we will give you reasonable notice and an opportunity to export your library.
16Changes
We may update these Terms from time to time. If a change is material, we will give you reasonable notice in the app or by email before it takes effect. Continuing to use Recall after a change takes effect means you accept the updated Terms.
17App Store & Apple terms
This section applies because you obtain Recall through Apple's App Store.
This agreement is with us, not Apple. These Terms are between you and Nustream Digital Ltd only. Apple is not a party to them, and Apple is not responsible for Recall or its content.
Scope of licence. The licence granted in section 3 is limited to use on Apple-branded products you own or control and as permitted by the App Store Usage Rules.
Maintenance and support. As stated in section 11, we — not Apple — are solely responsible for support; Apple has no support obligation.
Warranty. We are solely responsible for any product warranties. If Recall fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the app.
Product claims. We, not Apple, are responsible for addressing any claims relating to Recall, including product liability, any failure to conform to legal or regulatory requirements, and consumer protection or similar claims.
Intellectual property claims. We, not Apple, are responsible for the investigation, defence, settlement and discharge of any third-party claim that Recall infringes that party's intellectual property rights.
Legal compliance. You confirm that you are not located in a country subject to a US Government embargo or designated as "terrorist supporting", and that you are not on any US Government list of prohibited or restricted parties.
Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms, and on your acceptance Apple has the right to enforce them against you.
Contact for claims. Questions, complaints or claims about Recall should be directed to Nustream Digital Ltd at support@recall-app.ai.
18Governing law
These Terms and any dispute arising from them are governed by the law of England and Wales. The courts of England and Wales have non-exclusive jurisdiction, and nothing here prevents a consumer from bringing proceedings in their country of residence where the law gives them that right.
